Loyalty Program Terms and Conditions

These Terms and Conditions (“Terms”) describe the terms on which we, MillerHome Furniture & Mattress, and its affiliated company, Ashley of DuBois, PA, provide this Loyalty Program (“Program”) to our customers. By enrolling in the Program, you agree to comply with these Program Terms.

NOTE: THESE PROGRAM TERMS INCLUDE A WAIVER OF YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION AND A BINDING ARBITRATION CLAUSE

1. Eligibility:

• The Program is open to individuals aged 18 years or older who reside in the U.S.
• Employees of MillerHome Furniture & Mattress, Ashley of DuBois, PA and their immediate family members are not eligible to participate.

2. Enrollment:

• Enrollment in the Program is free and requires completion of the enrollment form available at https://account.clutch.com/millerhomev2
• Only one membership per person is permitted.
• To enroll in the Program, you will be asked to provide your name, a 10-digit telephone number and email address. You will be asked to select a password for use with the Program according to the password requirements shown on the Program website. At enrollment, you may optionally provide us with additional information such as your décor preferences and style, birth month/day and your home address. We call the information that you provide to us your “Member Profile”, which you may update through the program website at any time. We will use the information in your Member Profile to customize your Program benefits to you, in addition to other uses allowed by the Privacy Policy.

3. Communication Preferences:

• When you enroll, you will also have the opportunity to select your communication preferences. These preferences allow you to determine how you receive communications from us. By enrolling and participating in the Program, you agree to receive communications from us according to your communication preferences. You may update your communication preferences and information at any time at the Program website. You may opt out of the email and/or the text messaging (“MMS Program”) Programs at any time by following the instructions in such communications.

4. Earning Points:

• Points are earned based on qualifying purchases made at these participating locations - MillerHome Furniture & Mattress and Ashley of DuBois, PA.
• Points cannot be earned on taxes, shipping fees, delivery charges, protection plans or certain excluded items as determined by MillerHome Furniture & Mattress and Ashley of DuBois, PA.
• Earned points will be added to your balance upon delivery of the qualifying purchase.

5. Redeeming Points:

• Points can be redeemed for the equivalent of $1 per each reward point on qualifying merchandise.
• Rewards are subject to availability and may be changed or discontinued at any time.
• Earned Points cannot be exchanged for their monetary value.
• Points will not be refunded as cash on returned items, but will be credited back to your loyalty account.

6. Expiration:

• Points do not expire.
• MillerHome Furniture & Mattress and Ashley of DuBois, PA reserve the right to modify the expiration policy with notice to members.

7. Termination:

• MillerHome Furniture & Mattress and Ashley HomeStore of DuBois, PA reserve the right to terminate or modify the Program at any time.
• Members may terminate their participation in the Program by notifying MillerHome Furniture & Mattress and/or Ashley of DuBois, PA in writing.

8. Privacy:

• Personal information provided by members will be handled in accordance with our Privacy Policy.

9. Limitation of Liability

• MillerHome Furniture & Mattress and Ashley of DuBois, PA are not liable for any errors, delays, or failures in the Program’s operation.
• Members agree to release MillerHome Furniture & Mattress and Ashley of DuBois, PA from any claims related to the Program.

10. Modifications:

• These Terms are governed by the laws of Pennsylvania, without regard to its conflict of law provisions.

11. No Transfers:

• Your Program membership, and the benefits and promotions available to you through the Program are personal to you and may not be transferred to anybody else.
